CIDH CONDENA ASESINATO DE DEFENSOR DE LOS DERECHOS LGBTI EN MÉXICO

Washington, D.C., 10 de mayo de 2011 - La Comisión Interamericana de Derechos Humanos (CIDH) condena el asesinato en México de Quetzalcóatl Leija Herrera, quien fue presidente del Centro de Estudios y Proyectos para el Desarrollo Humano Integral (CEPRODEHI) y trabajaba en la defensa y promoción de los derechos de las personas lesbianas, gay, trans, bisexuales e intersexo (LGTBI) en la ciudad de Chilpancingo, Guerrero.

Según la información recibida por la CIDH, Quetzalcóatl Leija había participado en la promoción ante la Legislatura del Congreso Local de la “Ley de Sociedades de Convivencia”; el impulso a la “Iniciativa de Ley para Prevenir y Eliminar la Discriminación en Guerrero”; la denuncia de 16 procesos penales presuntamente relacionados con crímenes de homofobia; y la organización de seis marchas del orgullo gay en el Estado de Guerrero, entre otras actividades de defensa de los derechos de las personas LGBTI. La información recibida indica que el cuerpo del activista fue encontrado en la madrugada del 4 de mayo de 2011 a un costado del Antiguo Palacio de Justicia de Chilpancingo, con un golpe en la cabeza que le habría desfigurado parte del rostro.

La CIDH recuerda que es obligación del Estado investigar de oficio hechos de esta naturaleza y sancionar a los responsables. Asimismo, la Comisión insta al Estado de México a adoptar en forma inmediata y urgente todas las medidas necesarias a fin de garantizar el derecho a la vida, la integridad y la seguridad de los defensores y defensoras de los derechos de las personas LGTBI en Guerrero.

Como lo ha señalado anteriormente la CIDH, el derecho de todas las personas de vivir libres de discriminación está garantizado por el derecho internacional de los derechos humanos, y específicamente, por la Convención Americana sobre Derechos Humanos. En este sentido, la CIDH urge al Estado de México a adoptar acciones urgentes para evitar y responder ante abusos a los derechos humanos, incluyendo la adopción de medidas de políticas públicas y campañas contra la discriminación basada en la orientación sexual para evitar la repetición de crímenes como éste.

La Comisión recuerda que la labor de defensores y defensoras es esencial para la construcción de una sociedad democrática sólida y duradera, y tienen un papel protagónico en el proceso para el logro pleno del Estado de Derecho y el fortalecimiento de la democracia. Los actos de violencia y otros ataques contra las defensoras y los defensores de derechos humanos no solo afectan las garantías propias de todo ser humano sino que atentan contra el papel fundamental que juegan en la sociedad y sume en la indefensión a todas aquellas personas para quienes trabajan.

La CIDH es un órgano principal y autónomo de la Organización de los Estados Americanos (OEA), cuyo mandato surge de la Carta de la OEA y de la Convención Americana sobre Derechos Humanos. La Comisión Interamericana tiene el mandato de promover la observancia de los derechos humanos en la región y actúa como órgano consultivo de la OEA en la materia. La CIDH está integrada por siete miembros independientes que son elegidos por la Asamblea General de la OEA a título personal, y no representan sus países de origen o residencia.

IACHR CONDEMNS MURDER OF LGBTI RIGHTS ACTIVIST IN MEXICO

Washington, D.C., May 10, 2011 — The Inter-American Commission on Human Rights (IACHR) condemns the murder in Mexico of Quetzalcóatl Leija Herrera, who was president of the Center for Studies and Projects for Integral Human Development (CEPRODEHI) and worked to defend and promote the rights of lesbian, gay, bisexual, trans, and intersex persons (LGBTI) in the city of Chilpancingo, Guerrero.

According to the information the IACHR has received, Quetzalcóatl Leija had participated in promoting the "Law of Societies of Coexistence" before the Legislature of the Local Congress; advocated for the "Bill to Prevent and Eliminate Discrimination in Guerrero"; reported to the authorities 16 cases allegedly involving homophobia-related crimes; and organized six gay-pride marches in the state of Guerrero, among other activities to defend the rights of LGBTI persons. The information received indicates that the body of the human rights activist was found in the early morning hours of May 4, 2011, next to the Old Palace of Justice of Chilpancingo, with a blow to his head that had disfigured part of his face.

The IACHR calls to mind that it is the State’s obligation to investigate acts of this nature of its own accord, and to punish those responsible. Moreover, the Commission urges the State of Mexico to immediately and urgently adopt all necessary measures to guarantee the life, integrity, and safety of those who defend the rights of LGBTI persons in Guerrero.

As the IACHR has indicated before, the right of all persons to live free of discrimination is guaranteed by international human rights law, and specifically by the American Convention on Human Rights. In this regard, the IACHR urges the State of Mexico to take urgent steps to prevent and respond to human rights abuses, including adopting public policy measures and campaigns against discrimination based on sexual orientation, to keep crimes such as this one from happening again.

The Commission recalls that the work of human rights defenders is critical for building a solid and lasting democratic society. Human rights defenders play a leading role in the process of fully attaining the rule of law and the strengthening of democracy. Acts of violence and other attacks perpetrated against human rights defenders not only affect the guarantees that belong to all human beings; they also undermine the essential role human rights defenders play in society and contribute to the vulnerability of all those whose rights they champion.

A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has a mandate to promote respect for human rights in the region and acts as a consultative body to the OAS in this matter. The Commission is composed of seven independent members who are elected in a personal capacity by the OAS General Assembly and who do not represent their countries of origin or residence.
